Central NY man avoids jail in cell phone swindling case

AUBURN, N.Y. (AP) - A central New York man who admitted tricking a cell phone salesman into giving him dozens of phones has been ordered to serve 150 hours of community service.

Ryan Breen of Savannah admitted he convinced a Cingular salesman that he was employed with the same company and needed more than 150 cell phones to make upgrades for customers. Breen was fired by Cingular prior to the thefts and used his inside knowledge to convince the salesman they both worked for the same company.

As a condition of his sentence, Breen also paid back the nearly $30,000 he stole from Cingular. He pleaded guilty to fourth-degree larceny in Cayuga County Court in April.

Breen also faces charges in nearby Wayne County for apparently scamming over $200,000 in reimbursements from a medical insurance company for unrendered services. That case is still pending.
